I work for a University with H-1b approved till 2014 (past six years). I also have a US Bachelor's degree and married to a green card holder.
In 2010, I was lucky to get my first stamping in Vancouver after four days of waiting with 221-g. I am daring to go again but looks like the next...
As far as I know and understand, the PD is your to keep forever regardless of the status of I-140. So yes you can retain the date but you have to start the GC process all over again that is starting with PERM. Talk with the company lawyer or seek professional advice.
"Which job requirements? I don't understand much..."
Let's say you are applying for a JOB A with Company X. The requirement says M.Sc Applied Geology + 2 years of experience. If you qualify and get the job and the company is willing to sponsor GC, they might be able to file it under EB2. So...
I recently got a three year extension based on the approved I-140. I applied with a premium processing. After the DOL approval was done, it took to ten days. I work for a University not consulting so don't know how it will be for you. But I think you don't have to wait till Nov 2011. You can...
Please consult a lawyer. But if I understand the situation correctly, yes, I think you can apply for another H1b while the other one is pending. I think the new company will need to start a new application. Even though if the first one gets approved, "transfer" is basically like another...
Hi All,
I recently got married to a GC holder who will be able to apply for citizenship in July 2012. In the mean time we are considering applying for GC through her GC.
I am currently in H1b in sixth year with a three year extension which will expire 2014. I have a I-140 approved from a...
* Can she work with her current I-94?
As far as I know, you don't need I-94 to work (http://www.cbp.gov/xp/cgov/travel/id_visa/i-94_instructions/filling_out_i94.xml). It is needed for arrival and departure. So I think she can work without the new I-94.
*Is going out of USA and getting it...
Hi,
If your H1b is valid from employer Y and you have all the appropriate papers (letter from employer, pay stub etc.), then status of I-140 shouldn't matter. As you don't work for employer X anymore, it is natural for them to withdraw the petition. However, that does not impact the current...
Here's more information about special registration:
http://www.ice.gov/nseers/
If you are subject to it, please allow at least 2-4 hours of delay.
Nonimmigrant alien visitors subject to NSEERS registration at the port of entry:
* Certain citizens or nationals of Iran, Iraq, Libya, Sudan...
If you are subject to special registration, then you have to use the port of departure/entry (NY in this case) to register, not Chicago. Otherwise, as far as I know, there are no other restrictions. But I would call the CBP at the airport if you can.
you should talk to your institution's international office/attorney. However, for H1, I think only requirement is that the job ad needs to be mention a specific field of study. For instance, if it mentions just Bachelor's Degree, it is not ok. It has to say Bachelor's in Mathematics.
So if the...
Hi,
Talk to a lawyer and go over all the options. I think there are knowledgeable persons in this forum but a professional opinion while costly is the best option. My gut reaction to your situation would be to find a solution that will help you get the MBA and green card in the next 2-3 years...
EB2 is based on the job description not your qualifications. If you are currently in Job X, where the requirement mentioned is Bachelor's + 2, then you only be able to apply for EB3. However, if Job Y requires Bachelor + 5, then it allows you to apply for EB2.
The term to use is "withdrawal of I-140" not revoke. I think employer has the right to revoke. I am not sure if it is best to request them not to withdraw or not mention anything. You probably need to gauge the situation yourself and look at all consequences.
As far as I understand, the PD is...
I would advice to go over the requirements of H1b carefully:
http://www.immihelp.com/visas/h1b/h1b-visa-requirements.html
As far as I know, Bachelor's degree is a minimum for any H1b position. F1 usually has option for OPT or CPT. If H1b is not a possibility, you can look into those options...
Sorry, there's no way to predict these things.Uusually, home country suppose to be a safer bet than the third country option. If you know anyone from your country that recently visited the embassy, then maybe you can figure out a pattern.
Here's some information about 221g...
Hi,
I think everyone will agree that these experiences vary -- depends on the location, the counselor among other things. Are you going to the consulate at your home country versus a third country? Last year, I went to Vancouver for the first time stamping. Overall it went smoothly. I got the...
Hi,
I think some clarification is needed in order to answer some of your questions.
1. I-140 usually implies you have a employee that is sponsoring a green card application. Is that the case? I am not sure what you meant by "I have an I140 approved".
The timeline for 485 will depend on what...
Hi,
Are you on EB2 or EB3? First you need to make sure you are eligible for the AC21:
* New employment must be the "same or similar" occupational classification;
* Form I-140 has been approved, or is approvable when filed concurrently with I-485;
* Form I-485 has been pending for...
