- If you are using EAD, BCIS does not know that. This is because the I-9 you update with the HR is not sent to any govt. agency (including BCIS)
- So technically you can use the H1 to re-enter even if it has 4 days left before expiry (given all my...

I would think it will depend why your first case was rejected.
In my case I left the company right after my I-140 was approved.
Could not re-use any of the priority dates or documents when I restarted the process with the current company.
Currently waiting the approval of my second...

it is a very simple process. The local SSN office just looked at my wifes passport and EAD card.
The SSN offices have access to the BCIS "approved EAD database"
So when you present your valid EAD card, they look you up in the approved EAD database and accept your application.
They will...
I applied for I140, 485, EAD and AP in sept 2003 (Vermont)

I-140 and 485 files in 2003 Sept.
I have 5 months remaining on my H1 visa.
I also have a EAD card which is valid for the next 10 months.
The company is in the process of a merger and might eliminate some jobs.
What are my options now.
1. Are there any benefits of staying on H1...
Filed for I-140/485 concurrently in 10/10/2003 in VSC
Got my EAD card on 11/15/03
H1 is expiring in 7/1/2004 (so about 8 months left)
Company is not doing good and can lay off people now.
Given all the above facts
- Is it better to be on H1 or use EAD card ?
- What happens to...
Lets say I apply for my I140/EAD/I485 together.
I get the recipt for all 3 filings.
In 90 days I get my EAD card and I start using it insted of H1. So my I140 and I485 are still pending.
1. What happens if I loose my job before my I140 is approved. Is my EAD card still valid. How many...

My new employer had filed for a I-140 and I-485 in Aug 2003. The current priority date for I-140 in VSC is Oct 2002.
1. Can I reuse the priority date from my approved I-140 (from old employer)
2. If yes, What is the...

So I had to follow the non-RIR process and the company has to place ads, conduct interviews and go thro the whole...
