If you have valid and unexpired H1-B in your passport, then you do not need Visa. Otherwise, even if you have AP or EAD, you still need Visa. Thats my understanding.

I-140 is related to the employer. Your employer must have received the reason for the denial. Talk to your employer and ask your employer to correct that mistake when in the reappeal process.

I got my ap in 4 weeks. Applied in Jan 11 and approved on Feb 08. No RFE.

My friend was told that it will take 4 to 6 months to get the card. But, he got it in 2 weeks. May be he is lucky.

In my case, my attorney and me both got FP notices. Check with your attorney. (S)he must have got one too. But, you know, they dont tell you unless you ask them. Isn't it ? JK.

You will have to attach a "Non availabilty" certificate from your city of birth. Without that, notarized copies from your parents/brothers dont help.

Sure. -------- EB3 RIR PD Jun 02 140 & 485 RD- Jun 02 EAD & AP - Apr 04 FP Dec 04 I-140 & I-485 LUD change in Dec 04 after FP. EAD & AP - 2nd applied in Jan 05. Attorney query - Jan 10. 140 - approved jan 11.( is it coincidence ?) LUD changed twice. No LUD change for I-485 till today.

Right now TSC is processing April 04 cases. If your case was filed in Feb 04, it does makes sense to initiate a query. Thats what I did. :)
