If you have valid and unexpired H1-B in your passport, then you do not need Visa. Otherwise, even if you have AP or EAD, you still need Visa. Thats my understanding.
I-140 is related to the employer. Your employer must have received the reason for the denial. Talk to your employer and ask your employer to correct that mistake when in the reappeal process.
In my case, my attorney and me both got FP notices. Check with your attorney. (S)he must have got one too. But, you know, they dont tell you unless you ask them. Isn't it ? JK.

All the processing of I-485 is something to do or mostly with the PD's. So, when you are posting, post your PD also. That helps.
