No, mine was moved to TR after BEC came into existence. My lawyer was referring to this occuring of moving to TR from RIR being a common thing even before that and that all of them eventually got the approvals.
Oo, no way, rebuttal wont help in this case because they have already determined that the employers efforts were not satisfactory. She thinks we wouldnt stand any better chance by rebutting. (and i think so too).

Last time i had my lawyer do a screenshot was in Jan 06 and it showed RIR then. Never bothered to do another screenshot. My lawyer and i are both anxiously waiting for further communication from them, but nothing yet. We think it may be additional 45 to 60 days to go through the procedures.

Did you employer not receive any info as well? When did you first notice it being pushed to TR? This may give us insight as to how long before we can expect further instructions from them. Sorry to hear that, hey but atleast you are not alone.

danaya, im not sure of how bad this is, but my lawyer said it may take another 45 days and he is very positive about this whole ordeal. The procedure that we may have to go thorough is a regular TP process.

I can only speculate, but it may have to do with bubble burst and consequent massive layoffs all over around that time period. They probably scouted through the applications and figured that too many qualified US/GC candidates were available then to fill the jobs and they are doubtful...
