j1 to F1, Married to a LPR

HI,

I am currently on J1 visa (with two year residency requirement). I was not aware of the 2 yr requirement part and came to know about it only recently. My spouse is going to apply to LPR next month and we got married last month so that we could adjust status together. I just realized that given the two year residency requirement, I will not be eligible to adjust my status. I had a few questions: 1. I wanted to transition from J1 to F1 in August. Does being married to a LPR affect my ability to get F1 in the future? 2. If I apply to F1 visa in the US consulate and if my F1 visa gets rejected, does my J1 visa get rejected automatically as well?

In addition, If I apply to F1 visa in the US consulate and if my F1 visa gets rejected, does my J1 visa get rejected automatically as well? my J1 visa can be extended for 4 more years.

If I were to go the route of green card, does marrying a future LPR within 90-days of entry to the US affect the possibility of AOS being denied due to the “90-day rule"?

Can I attend university as a student while i485 is pending? Or do I have to continue to maintian J1 visa and be an exchange student?
 
I will let others answer other aspects of your questions. But any question about AOS & I-485 is irrelevant before you either 1. obtain a waiver of the home residency requirement (if you got U.S. government funding it's usually difficult to obtain a waiver), or 2. go back to your home country and physically reside there for 730 days. Without 1 or 2, you cannot adjust status to GC (if living in the U.S.) or obtain an immigrant visa (if abroad).
 
I was wondering if
1. Can I apply for the j1 waiver through no objection route and AOS at the same time? At which stage of the waiver processing can I apply for a AOS?
2. My ds2019 and visa says I do not have the 2 years requirement. However, according to the skill set of my country it says that I have the requirement. I do not want to do an advisory opinion before applying for the waiver, since the advisory opinion will take 4-6 weeks, and I am in a time crunch and want to apply for I-485 in the next 4-6 week. Can I apply for the waiver if I am not subjected for 2 years requirement based on my visa and ds2019?
 
1. In principle, only when you have the waiver in hand you are eligible to apply for AOS. The reality is that if you apply for AOS, the waiver should be there when your case will be adjudicated. You might get a request for evidence at any stage of the process, though, which might cause delays or even a denial of your AOS application.

I-485 includes a question about the 2YHRR. How will you answer that if you don't know it yet?

2. Of course you may apply for a waiver even if you're not subject. In such a case, the State Dept. will just inform you that you're not subject and that't it.
