No longer working for sponsoring employer.
I am thinking of apply in EB2 PERM and I 140 via new employer
Questions:
IF I 140 for newer EB2 labor gets denied then does that...

It's probably old thread I am reviving but I am struggling with similar issue.

1. Yes you can work for your previous employer.
2. No apply another transfer won't help you since query and issue was related to your paystubs.. I am assuming you didn't have all of recent ones in hand.
3. Your wife's status is derivative of your H1 right?
In that case she's okay to return...

I think deadline for application was by Apr 2001.
So out of status wasn't a big deal for you by then I think.. check with lawyers
