Recently got GC, is follow-in possible for spouse

Since her visa is long enough to wait out FB2 I-130, this is the simple route to take. If she has desirable skills, H1B and then GC will be faster (abt 3 yrs vs 5+ yrs for FB2).

    GC renouncement Questions

Thanks for your reply. So what forms do I need to fill out to pay the penalty and tax? Is it 1040NR for both?

    GC renouncement Questions

Another question What happens to my 401(k) after I renounce my GC? If I withdraw before 59.5 yrs old, do I still need to pay 10% penalty? Also, how much tax do I need to pay? If I withdraw a small amount each year, does that mean I only pay the lowest income bracket each year?

Expired Re-entry , any way to go back to U.S

If you do have a health condition, bring any evidence with you while you enter US. Tell the IO the truth and show him the documents. He cannot deny your entry that time if you tell the truth. But he might send you to an immigration judge. If what you said is true, you have a very good case to...

GC holder outside US for almost 3 years, OK to come back?

That means she can stay in the US indefinitely without any problem once she gets in. But if you want her to sponsor her children, then you have to commit fraud/perjury.

If this is true at all airport, I think many people will get caught at the PoE.

GC holder outside US for almost 3 years, OK to come back?

Well, I always told the truth to the IOs (because I didn't have to lie I guess), so I really hate that the law enforcement part of the immigration laws here is very lax. Many people lied to maintain their GC and they didn't get caught. It seems to me it is very simple to scan GCs during...

    Maintaing Permanent Resident Status

Are you sure they have all the data? A friend of mine claimed that he only comes back every six months but when IO asked, he said he was out only two months. Never had a problem so far. I highly doubt they know your exit dates.

GC holder outside US for almost 3 years, OK to come back?

I think your mom needs to lie and then commit fraud when she applies GCs for your siblings. But what is the punishment for lying to an IO about how long you were out of the country? I have many friends did just that but they were never caught. I really want to know what the punishment is. Is...

    Maintaing Permanent Resident Status

Is checking your past entry dates on passport the only way an officer can determine how long you have been out of the country? If so, no wonder many people chooses to come back only once every six months to maintain their LPR.... But this doesn't quite make sense. If I stay in the US for a...

    Maintaing Permanent Resident Status

It is worth a try definitely. There really is not much to lose to try. But I haven't heard of anyone tried this yet, so he can be the first. :)

    GC renouncement Questions

Yeah I am from HK. What is that "healthy income exclusion"? Do you mean if my overseas income is below this number, then I owe no US taxes? If this number is really high, maybe I can also think about becoming a US citizen.
