    EB1-OR experiences/suggestions

IMHO (H = humble) Honkman sets ridicculous standards for OR. I got approved with 6 pubs, 100 citations, 13 letters (6 were clearly independent, all connected in some way to my former advisor, i.e. former grad students or post docs that I did not overlap with, they are doing really well...

    attorney fee dispute

    1. Name the attorney and his/her address. These scumbags need to be brought to light. 2. I don't think you are obligated to pay, since your I-140 was not approved. Since this is an NIW, you have the power to withdraw the petition yourself, so it will never be approved. 3. If you a paper...

Fresh PhD : eligible for EB1 OR

Nice for you but perhaps one day even you will understand that there are certain official rules which might apply or not and people should know them to make their own judgement. This is exactly why you should not be making blanket statements such as needing three years post Ph.D. The...

Fresh PhD : eligible for EB1 OR

I think you will do fine for OR, as long as your job is that of a researcher., and your company is well reputed. Your case will hinge on the letters that you can get. Honkman, for Christ's sake stop telling people that they need 3+ years experience post Ph.D. for OR. THIS IS NOT CORRECT. I...

do i meet requirements for EB1-OR

Ph.D. is NOT essential for OR. Is your position a research based one? If not, you will not qualify for OR anyway. Engineering can be tricky to present to USCIS.

    Passport copy for EB1-OR

Sumbit COLOR copies with both applications. I was asked by my lawyer for color passport copies prior to my OR being submitted.

Is my background OK for NIW?

This is all wonderful. Now how does this affect the national interest of the US? You should read the sticky posted above regarding NIW petitions, and post more details regarding your work itself for people to give their opinions.

Honkman, congrats! Please continue to advice people on this forum even though you are done.

How many independent recommendation letters needed for OR?

I agree with Honkman's comments on this thread. I would not consider your colleague's letters to be independent either, and you should ask yourself as to whether they can claim to be "experts in the field" since they belong to the same generation of scientists as you. The number of letters...

    EB1-EA Category

The reason that I came out strongly on this issue is that I don't want people without Ph.D.'s to think that they will not qualify for EB-1OR or NIW (maybe even EB-1EA under exceptional circumstances). Each case is unique, and things depend on overall qualifications and on how the case is presented.

    EB1-EA Category

What is absolutely necessary for EB1 and NIW is to satisfy certain criteria. Just because someone has a Ph.D. or MD does not automatically make them eligibile for these categories. However, the path to such an advanced degree does confer some of the required eligibility by the very nature of the...

    EB1-EA Category

ScionF, I urge you to read the EB-1EA article that is a sticky above VERY carefully, preferably MANY times. Advanced degrees are not a prerequisute for EB1 or NIW. I have heard of plenty of MS people getting EB-1OR and NIW.

    Case Evaluation for OR

I don't agree with your lawyer!!! How many publications do you have in international journals? I really don't think the citations matter a whole lot. If you have several publications in good international journals, letters from big shots in your field that you have not worked with and a...

RFE, O-1 job: Need a letter from employer?

Hmmmmm....... I don't know about you, but a lot of people are not good at divining what exactly you are up to with USCIS......Posting some details might help.
