    Thank you for you response. Isn't there a law that says that I have to leave the US with a US passport though? Also when I show my EU passport, isn't the airline going to ask for the I94 ? Since I live in the US I don't have the I94 so it may lead to more confusion.

    From what you explained you should speak to a lawyer right away. It doesn't have to be criminal for the INS to deny your application based on moral turpitude. Don't want do sound too harsh but you were in fact stealing money from the government by commiting tax evasion.
