When should I go back to India for H1-B stamping?

Now I am applying for J-1 waiver. I was wondering when should I go back for H1-B stamping? Should I go now before I start J-1 waiver job once it's apporved or may be once I start J1- Waiver job? Does it matter? It does not matter when you go. What matters is what you file with the USCIS...

Time frame for J-1 waiver filing for Pennsylvania

PA usually takes 3-4 weeks to submit to DOS. Then, DOS takes 4-6 weeks to submit to USCIS. Then, it is variable. Sometimes, the H1B gets approved before the J1 waiver. In this case, one can start working however the J1 waiver clock only starts when you get the J1 waiver approval. One option is...

What happens if Employer backs out after J-1 waiver approval but before H1-B filing?

Employer is also bound to a contract as you are. So, the employer will have to abide by the contract depending on what it states.

    Wo-hooooooo !!!

Congratulations to you! I just received the greencard in the mail also. I got it through my husband's EB-1 petition as a derivative. It took 1 1/2 years since he applied and 2 months after completion of my J1 waiver. It sure feels good. Thanks for all your help during this process.

Applying for J1 Visa while on I-140

It is likely she will get rejected for a J1 visa. If she does get accepted, then she will have to do her J1 waiver prior to adjustment to GC status.

    Please advise...urgent!! ****

Since there is such a backlog for EB2 immigrant visa numbers, the best bet for Indians (at least currently) is to apply for EB1 category. This involves requiring research publications (among other things) usually harder to achieve in Psychiatry than other medical fields.

    Please advise...urgent!! ****

Most people will agree that taking H1B is better as you do not have to deal with J1 waiver. But it is an individual decision. I chose J1 as I wanted to do Child Psych fellowship (4+2 or 3+2) and also wanted to transfer out to a different program after PGY-1. I thought it would be easier to...

    Please advise...urgent!! ****

For similar reasons, some years ago, I took the J1. However, will advise you to take the H1B. You can moonlight as a PGY3 and also get someone to file your GC for future employment by the end of your PGY3. Alternatively, if you do end up taking the J1, then finding a waiver is also not...

Want to cut down hours after getting green card

technically, once you have the GC you are free to do whatever you want. there are no real guidelines on how long one stays with the employer or nature of work, etc. All these things you hear fall under 'advisable" but don't think there are legal bindings.

Fellowship on H1B premium processing or J-1 -- timeline

There is no simplistic answer to your question because it depends on your long term plans. If your husband is only coming to the US for a 1-year fellowship and plans to return to your country at the end of it, then J1 would suffice. However, if you are planning to immigrate to the US, or keep...

    green card filing! Pls advise

Logically, AP should have no connection but somewhere it could imply that you have already filed for adjustment of status which is defying the J1 waiver ruling. You have to weigh which scenario is less risky for you and go with it.

    green card filing! Pls advise

Answers to your questions depends on the country you were born in. If you happen to be from India,China (the retrogressed ones), then you cannot file for I-485 until the priority date is current. You cannot get EAD/AP until you file for I-485. If you are not from a retrogressed country, then you...
