have lived in usa for over 30+ years now ?

You could consider applying to Canada. Since you aren't convicted of anything you should still be eligible for visit visas to the US. At some point there might be amnesty for people like you but Canada would offer a clean slate possibly.

My wife is in removal proceedings. We can't afford a lawyer. What should we do?

If you are low income or indigent then you qualify for free or very low cost legal assistance. Problem solved. The money problem, at least.

    Sponsoring my mother.

I wonder if there is any way to get "advanced parole" from the consulate after stating to the consulate her intention to pursue a green card, or some similar procedure? I know there are some dual purpose visas such as the H1B where they don't hassle you if you adjust status to an LPR. But why...

212 C relief Question (conviction before april 1996)

She can use it as a precedent even now hopefully. Do you have any more information on the case besides that in this PDF? http://www.justice.gov/eoir/vll/intdec/vol21/3289.pdf

Why don't you start by ordering for yourself your FBI file and see what's in there to begin with.

Arrest for DV Charges and Dismissal after pretrial diversion

If I didn't post in this thread then why did you address me before I even posted in this thread? That's what made me think I had a post. Well if they have an arrest record only then I believe all you have to do is say you were arrested but there were no charges filed and that should end the...

Arrest for DV Charges and Dismissal after pretrial diversion

What happened to my previous post in this thread? I don't even remember what I said. Anyway, since it was liquidated in pretrial diversion you were not officially "charged" with it through a court system then were you? So it was an arrest and suspicion of but there was no final disposition...

    TPS for pakistanis

Well since it's not even law yet I guess everything about it is an opinion no matter who it comes from, lawyer or not.

    TPS for pakistanis

This could help a lot of Pakistanis out of status. One of the benefits if I understand correctly is that all paperwork submitted will cost no more than $50 in terms of the fees required. Quite a savings if it works out for someone. However, this bill was killed once before last year in a lame...

    amended I-485 w/ arrest

Hold on, were you ever officially charged? Booked? If not then you could possibly answer yes to the arrest and no to the "have you ever committed whatever..." since if there was no arrest there was obviously no conviction. What was the "charge" again?

    amended I-485 w/ arrest

They can no longer deny the 485 officially on the basis of misrepresentation by you because you amended your application *before* they came out and told you that they knew you had been arrested despite your claim you had not. That's only logical right? What they can do however is did deeper and...

    Getting Fingerprints Taken

Yes I believe it may look shady because the consul might tell you that he has reasons to believe that she wants to move to the US long term as is evidenced by her i130 as well as her relationship to a spouse and that she is using a visitor visa just to pass through inspection at the border...

    Getting Fingerprints Taken

Ok I was spaced out I didn't see the 10 years ago part. In 1996 there were some major changes in immigration policies which were later on challenged successfully. After 1996 there were also some changes many of which were also challenged so what you would do is go back in time to the year that...

    Getting Fingerprints Taken

Was she told the case would be erased without any consequences before 1996 or after 1996? If she was told that it would be erased after 1996 without any unfortold negative consequences then her rights to proper and effective counsel were violated and that's the argument she can make. If the...
