Continued residence and physical presence requirements:
I completed 5 years in November 2008 with absences every year. Three absences are more than 6 months. First absence of 10 months (February to November) with just three months stay in USA after immigration. As per my understanding then and confirmed with US Embassy in India, absences of more than one year will break the continued presence requirement. Although I had permission to be away for two years with re-entry permit, I came back in November 2004 after 10 months.
Completed 5 years in November 2008 and 30-months physical presence in March 2009.
1. What strong convincing grounds/reasons can be advanced to satisfy USCIS.
2. When should be the due date of filing N-400. 90 days prior to 5-year continued stay or 90 days prior to completion of 30-months physical presence
3. What is the process timeline in Virginia after filing N-400.
