work without authorisation by mistake

I have I797 approved to start working from Oct 1, 2007. So I started working from Feb 2008. I was one F1 visa and finished my degree in May 2008. Since I had I797 approved I never applied for OPT. Now the twist is that when I started working my employer didn't update my status, hence I came to know a week ago that I am working without authorisation and I will be out of status in two weeks. So I am leaving US tomorrow to go to India and get my visa stamped. My employer is helping me with all the documents I need from them. What are my chances of getting H1B stamped.
 
Check if your H-1 application said you are changing status from F-1 to H-1. You had to give your current status in the US if you were already there. Did your company send your H-1 to India?
