My husband is on E3 visa, and his company filed I140 for him (with my name added too) recently for green card. I'm holding h1b visa and facing layoff now, so I want to change my status to E3D. I'm filling the form I539 to change my status, there is a question in the form:"have you ever filed immigrant petition?" Can I answer no? since I haven't file I140 by myself, I'm only the derivative beneficiary of my husband. Or shall I answer yes? since my name is added in my husband's filed I140?
I'm worried about that this filed I140 will affect my E3D application, since E3 is not dual-intent visa. Can anyone help how shall I answer the question in form I539, and will my E-3D application get in trouble since my husband (E3 holder) has filed green card application?
