I have my current H1 valid till April 10 2008.
Company has filed for H1 extension in Dec 2007(3 years ext. as I am still in 6 years cap).We got the receipt but no updates after that.
I know at present USCIS is processing Oct 2007 H1 cases.
My question is : In case I do not receive the H1 approval by 10th April 08, what is my legal status???
I talked to company lawyer and she mentioned that "your valid H-1B status will automatically extend for another 240 days (6 months). This allowance is designed to accommodate USCIS processing times and backlogs."
Is this correct?
