Can we link pending and or approved I-140 of company B to Pending 485 of company A

Can we link pending and or approved I-140 of company B to Pending 485 of company A and get rid of company A's I-140.

When it comes to approval of I-485 CIS will check for any available approved 1-140 on behalf of applicant, and visa availability.

Did u find a way to get a copy of Original Labor approval. one of my friend looking for same his original got missed. he applied his labor when he was in us a log time ago. after that he spent couple of years in india. but employer told that got original missed. so he was looking to get copy of it. if u have any idea please lee me know

Finally my I-140 and I-485 cases have been re-opened after the USCIS has received the copy of my labor approval from the Federal Labor Dept.

last 2 weeks back i posted I 140 ref ..need G28 form...after sending G28,
on sep 29th LUD changed for I 485, next on sep 30th LUD changed for I 140 …after my company called INS so many times , I 485 LUD changed .saying..(On September 29, 2005, this case was reopened on a BCIS motion, and the case is now in process. It is taking between 365 and 540 days ) ..for I 140 (On September 30, 2005, we received your response to our request for evidence or information. It is taking between 30 and 180 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.)I was little happy.. , b’cas atleast they reopened my case ….and also LUD changes on wife I485,,only date changed .
but any one explain or reply got same thing like this ...
and next ,if they ReOpend my I 140 and I 485 case means ,my I 140 is APPROVED or NOT

please reply or advise me my I 140 is approved or not ....b'case this year ending my 7th yr H1 extension is going to finish....or can I apply for 8th year extension …so please reply

No, it is just reopened, not approved.

Yes, you can file 8th year ext provided your LC is older than 365 day, which I assume it is as you are already on 7th year ext.

Please contact your local Senator and seek their help in expediting the process of obtaining the copy of Labor Certificate from DOL.

MTR/appeal fee was $110 when I filed last year, looks like it has increased to 385. At that time, it was same for MTR (290A) or MTR/Appeal (290B). So based on the same logic, I think you will need to pay $385 for MTR also. Just my opinion.
Your second question about H1 is not clear to me.

*I filed a marriage based I-485 in Dec 2003.
*1st FP was Jan. 2004.
*1st approved EAD April. 2004.
*2nd approved EAD Sept. 2004.
*Interview was Dec. 2004.
*USCIS claimes that they sent a Notice of intent to deny in May 2005. Never received such a notice. They can't even provide me with a copy of the notice.
*H1-B petition was approved JUly 2005.
*Immigration officer called me on Aug 2005 to attend FP on 8/16/2005.
*Missed 2nd FP bcos i was seriously ill. Letter noted that I could attend FP any other date after 8/16/05 for 84 days.
*I-485 denied Aug. 17, 2005.
*attended 2nd FP Aug 22, 2005.
*filed MTR Sept 2005.
*MTR approved/denied????? have no idea when this one will be opened. I hope pretty soon though.

My questions are:

1. do you guys think that I should file a new I-485? bcos God only knows when my case will be reopened. I have already been out of work for 1.5 mths.

2. how long does a decision on MTR take? I am completely lost on this matter.

3. Most importantly, can I continue to work based on my H1-B approval since my I-485 was denied? I spoke with an IIO and she informed me that I can continue working based on the H1-B.


I would truly appreciate any help anyone could render.

By the way, fee for MTR is $110 not $385.

Hi. That was my bad. The fee has increased from $110 to $385.

How long after 140 and 485 sumultaneous LUD changes did you get your first denial notice ? Can you recall ? I am in the same situation

LUD changed after RFE : 11/23 TSC EB3 (no denial notice yet)

I got REF on I-140 and I-485 yesterday as per online status as follows,,

On November 30, 2005, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283.

Can any one expect what it could be on both cases at same time??????

I am tense about this as both cases have REF at same time and also my wife and kids doesn't have any REF. I am waiting on REF leeter to reach my home or LAWYER.

does USCIS raise as an issue if the employment dates mentioned in the experience letters are slightly diff from what was stated in the original LC approval forms?

In my LC it was stated that my current employer is my GC sponsering employer. But, at the time of filing my LC, I've NOT started my employment with the GC sponser. I joined the company a year later.

Does this cause any problem in my I-140?

RFE and denial Notice ?

All those guys whose I-140 got denied, did you guys got RFE first and then after your RFE response that it got denied or directly after filing I-140 without a RFE ?
