My fiance is in Mexico and I am a US citizen. We were thinking about doing the K-3 visa route.. Filing the I-130 and I-129F.. My question is can she use a tourist visa to enter the country while she waits for approval of her K-3 visa? She already has a tourist visa and has been to the states two dozen times at least. But I have read else where that after submitting the I-130 my fiancee (well wife by then..) will be placed on a list designated for those who are at risk for overstaying their tourist visa and then denied entry into the country..
So is it possible to use a tourist visa while in limbo on a K-3 visa if you provide the officer at the border with proof that you plan to return to your home country.. such as a letter from an employer etc..
