Urget Q about Country of eligibility

Hi folks.....how are you all ...miss you all.

I have a q about country of chargeability (eligibility) that I have been asked by some folks..

if a person was born in a country from AF lets say Ghana, and he holds the Ghana nationality, and the same applies to his spouse and his parents. He lives and works in Saudia Arabia, and he claimed his country of eligibility as Saudia Arabia....and he got an 2015 AS number....so what is his situation do you think???

The person will/should be disqualified at the time of their interview. Chargeability is tied to place of birth, the person you listed above should have been selected with an AF region CN since the person was born in Ghana. An AS region CN could be perceived as giving the person an undue advantage.

The person should save their money and time, and forget about the selection.
 
thanks Sm1smom for ur nswer.....if he claims that his parents were born in Saudia , and that's why he put Saudia as his country of chargeability, will he be required to present a proof at the time of interview?

That would not help at all. Even if that were true it would still not create a scenario that meets one of the exception criteria.
 
thanks Britsimon....but why is that not creating a scenario of exception..It is clearly stated in the criteria of country of eligibility is that u can claim ur parents country of eligibility ??

because that scenario is for when a person is born in an I eligible country because their parents were there temporarily. But that clearly would not work even if it were true because Ghana is eligible. Couple that with the fact that the applicant would need to prove everything about the parents, and you have a clear answer. One cannot just make up a scenario and expect them to not check it.

First of all, if he does that and gets found out after he's been erroneously issued with the visa and and moved to the U.S., he will be charged with fraudulently obtaining an immigration benefit, he will be jailed following which he will be issued with a life time ban from the U.S.!

Also like Simon already pointed out claiming chargeability via the parent is only applicable if his country of birth is not eligible, Ghana is clearly eligible, and he will be required to furnish prove of parents' birth in Saudi Arabia.

Compounding the error with lies is a very foolish move IMO!
 
Agree that it's very clear on the rules this case will be disqualified. The best advice to give the person is to save his money and enter again in the next round after having checked and followed the rules correctly in filling in his entry form.
