University affiliated Not for profit community hospitals

You have mentioned that some University hospitals MAY be exempted from the cap. The USCIS has announced that non-profit entities are also exempted from the cap. Will this apply to University affiliated, Not for profit community hospitals.

Typical of CIS, we have no guidance. The language of AC21 exempts only two types of non-profits

1. those affiliated with universities ("an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a))), or a related or affiliated nonprofit entity")


2. nonprofit research organizations
 
So, does it mean that a hospital which is affiliated to a university and teaches medical students in its premises will be exempt?
