I am a new suer to this forum and I am seeking any and all help I can get! I am filling out an I-129 for an extension of status for a TN2 and am a bit stuck with the wording on a section of the form:
In part 4 page 4, under "Processing Information" on item 8 the application asks:
"Did you indicate you were filing a new petition in Part 2. ?"
In part 2 I said I was filing for:
option B: "Continuation of previously approved employment without change with the same employer."
And the requested action is to be: "Extend the status of a nonimmigrant classification based on a free trade agreement."
My question is, would this be considered a new petition or not?
I am confused because on item 9 in part 4 they application asks:
"Have you ever previously filed a nonimmigrant petition for this beneficiary?" which I said yes to since the employment will be with the same company for the same position and I have provided the explanation.
Any input will be greatly appreciated, thank you!
