I'm a US citizen and my wife has a permanent GC. She went to her home country. It has been 9 months but she might have to stay 6 more months because of family reasons. No, we didn't apply for re-entry permit before she left as we planned to come back sooner. What are our options? Our US born infant is with her too. I'm not sure that would help our case anyway.
I'm thinking that...
1) She can come back now. Stay few days (3 or 4 days) in USA and then go back to her home country. Then come back within 6 months. Is it legally alright? Will she face any issue at port of entry in either time?
2) She can come before 1 year. Will she face any issue at POE if she comes back before 1 year? We can apply for re-entry permit. Once her bio-metrics are done then she can go back again. Is it a better option?
3) She can stay there now. Apply for 'returning resident visa (SB-1)' and then come back. But what are the chances of getting SB-1 approved? Did anyone do it?
