My brother in law just lost his job recently due to company downsizing. He is under a pending I-485 filed sometimes in 2007 but the receipt date is 08/02/2007. He paid the old I-485 fees (i think it was $300something). He doesn't have any I-765 filed. His company agreed to keep the GC filing for him until it gets approved even though that he is no longer works for them.
Please advice:
1) What will be the best step for him now in order to find another job with this status?
2) Can he apply for I-765 based on the I-485 receipt?
3) Will the I-765 enable him to work for other company legally, while waiting for the I-485 approval? (2 different companies)
4) Will he needs to pay $340.00 for the I-765 considering he paid the old I-485 fees? (even though the receipt date is 08/02/2007 - it is after July 30, 2007)
Please give any best input.
