J-1 Dilemma

Hi,
I am an IT professional and was sent to US for 2 months on a J-1. visa. My company sent me on this visa because no other could be arranged for me.
My visa was issued for a period of 3 months and the visa expired on 8th Aug 2003. The visa has a 2 yr HRR printed on it.
My dilemma is that if now i want to go to US on an H-1B visa , how do i go about the waiver process of J-1. Could anybody list out the step by step process for obtaining a waiver sitting right here in India.
Regards,
Vishal Jain

Hi,

Look at these two links. The first one gives you pretty detailed explanation of the entire procedure. The second one is official DOS website for the waiver.

http://travel.state.gov/jvw.html

For specific information concerning Indian citizens browse archives of this forum (for J1 visas) as there are multiple posts for people like you.
Good luck,

Szymon

PS. You should be prepared to wait around a year to get a waiver.

No Objection from Whom?

Thanks for the first reply. There is another query which needs attention.
I am employed with Accenture Technology Solutions India. I had been to US for 2 months starting May 2003 on a J-1 visa sponsored by the above organisation.
As per the visa stamped, i am subject to the 212E 2 year requirement. Since i want to go in for a waiver application, i would like to know from whom should i get the No Objection letter:-
1) The Indian government,
2) or my company which sponsored me.

Kindly clear my doubt with regards to the above issue.

Your case is complicated.
Contact a lawyer in Bombay who deals with American immigration and visa matters.
