I94 Expires !!!

I works for company A and my I94 expires on April 13th2008.
I have transfered my H1B to company B and travelled to india and came back on Company A.

Due to some reasons I have not joined company B.

I m still with Company A and my employer applied for H1B extension.
I have applied a month before and not yet received EAC No from USCIS.

If any issue arises during Extension with Company A, Can I join with company B since it is valid till October 2009.

Please help !!!
 
I guess you did not work for company B.

Yes you can work for B if you want to as long as the H1 with B is valid.

You are allowed to work for A as well for upto 240 days after your H1 I-94 expires and you filed an extension on time.

If I travel to india now, will there be any issues for extension process ?

No, extension will get processed fine. You need to wait for the approval to return though. Or as an alternative, travel, get the visa stamp (if expired) return and work for B.

You had transfered the H-1B to employer B but returned on Employer A's visa. Hence since your return to the US your H-1B is legally tied to Employer A. Now if you want to join Employer B based on the approved visa, you have to depart the US and obtain a new I-94 at the point of entry corresponding to the valid H-1B visa (a stamping may be necessary).
