I130 Processing Times

Hi,

Need a calirification.

As of 11/14/2003, VSC is processing January 04 1999 cases of I130 (both U.S. citizen applying for married brother/sister and U.S. citizen applying for married son/daughter). But, on the other hand state department visa bulletin shows they are processing cases filed in 1992 and 1997 respectively for the above two categories.

Could any one help me find the missing link here? Are VSC and State department processing two different things. Who should I rely on in calculating my wait time, VSC or State dept?

I 130 & Proirity Dates

I 130 approval date and Priority date for Family based petition is two different set of dates.

I 130 approval is mere approval and confirmation of your eligibility through family based immigration.

Once I 130 is approved, you may have to wait even 14 years for Brothers/Sister Category to immigrate to USA if you are out side USA or Adjust your status if you are inside USA.

Visa Bulletin dates are real priority dates when you file first time I 130.


I 130 dates, from different service centers indicate just processing the I 130 petition only.

E.g.
Suppose you apply for your married son /daughters I 130 on Oct 10 2003. If you see CSC processing I 130 may be Sep 2000.

But Priority dates for this category is Aug 15, 1996.

Even your I 130 got approved on Oct 10, 2005, your priority date is only Oct 10, 2003.

You have to wait current priority date (i.e) Aug 15, 1996 became Oct 10, 2003. It may take 10 years or even more. Every month 15 days are moving.
