I don't understand your question. My earlier response clearly says that the RFE was about company's 'Ability to Pay'.

Hello Guys

On my 140 application got an RFE for educational degree. I have 3 yrs degree in Management , computer certifications & 11 yrs of experience at the time of filing labor.
I am working for the same company for last 5 years.
Mine is a EB2 Category & in my labor column# 15 it's mentioned Master's Degree or bachelor's degree & 5 years of progressive experience

Any suggestions as I want to make sure that the lawyer submits solid arguements as we can't do more that that.

Any helps is appreciated.

Did you submit a degree of evaluation at the time of filing?
Is it a substitite labor?

I have not seen the RFE but the lawyer says department is arguing that whu they should approve when the applicant's degree is of 3 years where as degree should be of 4 years.

We used the same evaluation which was used at the time of H1B

No it is original labor.
