RFE received

I did concurrent filing of I-485 with a copy of I-140 receipt. Now the INS has send an RFE on Oct 15th 2002. My lawyer hasn't received the notice yet. She might receive it tomorrow. Kind of anxious about the notice. I will post the RFE details here when I hear from my lawyer. It might be helpful for others. Here are my details:

I-140 filed under EB2-RIR.

RD: 07/15/02
ND: 07/18/02
RFE mailed by INS: 10/15/02

I-485 filed with RD: 08/15/02 and ND: 08/21/02.
Gave finger prints on 09/24/02.
Not yet received EAD or Advance Parole.
 
What was the reson ?

What was the reason for I-140 denial ?
Did you file I-140 in EB2/RIR category ?
I want to know since my I-140 is still under way.
I filed on May 8th and still waiting !

Hi Arvindbpatel,

My labor required 4 yrs of degree AND 5 yrs of experience.
I-140 was filed in EB2 category and INS issued RFE asking if we want to continue in EB2 category.

My attorney replied that we will continue in EB3 category.

INS denied my case saying LC required 4 yrs of degree and I have 3 yrs of degree...

My I-140 took almost 6 months and in the last it was denied......:mad:

Thanks for your quick reply.
I think I'm in the same boat like you since I have 3 years
degree and filed in EB2.

I would like to know more in detail about degree since
I have B.E. Computer degree which is evaluated equivalent
to B.S. Computer Science of United States.

If you don't mind can you tell me your degree.

Yes it is 4 year degree but I did it within 3 years since I had my
Diploma In Electronics done before my B.E.

I have post graduation and more than five years experiance. Still on the advise of my attorney I applied under EB3. I just applied for my I-140 a month ago. Still waiting for a decision.
 
Please help me ..... What shall I do the next step?
