I am on H1 waiting for Labor certification at PBEC. My PD is 03/2004. My wife is on H4. She has the opportunity to get a job on J1 for 3 years. She has to go to India and get the J1 visa. My question is how will her J1 status affect our Green card processing at the I-140 and I-485 stages? Doesn't J1 visa require the person to go back to their native country for 3 years. Is there any waiver that can be got for that if my labor is cleared at PBEC and I can go through I-140 and I-485 within 3 years? Or can she switch back to H4 at some stage during the 140/485 process. Thanks.
