Hi,
My status before Oct 2008 was H4. My H1 got approved for the corresponding cap year and was valid after Oct 1st 2008. I never used that H1 and applied for change of status to H4 in March 2009. My employer didn't provide me any of my H1 documents like I797 or any offer letter kind of thing. I also never applied for my SSN, and I applied for H4 w/o any pay stubs and I797 as I didn't have any.
My H4 is still in pending stage...
My question is say my H4 gets approved and I get a job after 2 months, and I will have to go back to H1,
1.) Do I have to go through the cap again ...
2.) Filing for H1 at that time..what documents will they ask from me...
3.) Will I have to leave the country after my H4 gets approved..
