I am on H4 right now and had filled for change of status to H1B under premium processing through a company who has offered me permanent emplyment. My case was filled on 14th October 2009 and now I have got an RFE.
Case filled from H4 to H1b - 14th October 2009 at CSC(California Service Center)
RFE issued- 27th October 2009.
Reason for RFE: Missing paystubs after June 2009.
Background: I was working on a project but lost my project in June and so I filled my H4 in July as my spouse is also working on H1b. Now I have got an offer for permanent employemnt and I want to go back to h1b but USCIS is requesting for my recent paystube even though I am on H4 visa.
I am not sure what kind of evidence is required by USCIS. Arey they asking about my husband's paystubs as right now I am on H4 and I am not working.
Please reply urgently. Also is there anyone in a simialr situation. How many days USCIS take for decision after RFE?
