My first H1b extension is pending with Vermont center for the past 6 months. we received an RFE and web site indicates RFE received in July and we should receive a reply in 60 days. After REF was submitted in July, till todate no response. MY problem is the following.
I have an EAD based of 485 and dont want to use it. But I heard that if H1b is pending for more than 8 months I am not allowed to work and need to switch to EAD to work.
is this true?. 8 months calculated from the date of receipt or receipt of RFE?. Its hard to believe that my 3000 dollars is gone into the air because of beaurocratic delay at USCIS(leave alone maintaining H1b status). what are my options here?
If possible I would like to stick with H1b. I have a good job and all pay stubs and I have been working continuously for the last four years.
