Hi all,

I am new in this discussion board, so please forgive me if my question has been answered before.

My wife just received the notice from Backlog Elimination Centers indicates that her labor cert has been approved, she was waiting for this since 2003. She received this notice couple days ago.

Her current H1-B (this is her 6th year) will expire in August, so she applied h1-B extension in the beginning of July. What I am trying to say here is she applied extension before she know her Labor is approved. According to the article (http://www.path2usa.com/immigration/h1bcorner/h1_7thyear_extension.htm) requirement 1, you can only apply extension when you are waiting for your Labor to be approved, so if she cannot meet the deadline of submitting I-140 before August 17th (I believe that's the deadline, isn't it?), will her H1-B extension be rejected? Thanks for the inputs!
