I am on H4 and have to get it stamped for certain reasons. I need a new H1b. I would like to file it now with dated of october1st 2004 as its advisable since the cap may be reached anytime my lawyer says. So if I file it right now and then go to india , get my passport stmaped with h4 , does my H1b processing get affected ?
