I have filled my H-1B Extension/ Change of Employer on July 29, 2013 with Employer B.
I got Request of Evidence from USCIS for asking my Maintaining of Non Immigrant Status from January 16, 2013 to July 29, 2013.
My H-1B Visa was approved from Oct 1, 2012 to Sep 30, 2015 . And my Employer A.
Employer A has revoked my H-1B on January 16, 2013 and Not Informed me and keep me on Payroll.
Now, after the getting RFE, I came to know that my H-1B was revoked and I asked Employer A, Why I am not been informed officially by Company for revoking my H-1B?
They now apologize and willing to support me to save my Status.
My Concern is
1. I got RFE, Should I response and stay in US untill the Final Decision is Made by USCIS?
2. How Successfully we can Respond the RFE and Get the approved H-1B? What are the Outcome?
3. Did I violated any laws ? What are the Penalty?
4. Should I leave US?
5. Should I eligible for apply any Visa? Like F-1, B1 etc?
6. What Action I can take against my employer?
7. Is any way employer can correct or reinstate Revoked H-1B?
Below is my Wife Information, She Came on F-2, Student Dependent Visa on May, 2013. She got H-4 when I got H-1 B on Oct, 2012.
Her F-2 Student Visa Stamp is Valid untill May, 2017.
She applied for L-1 A Visa.
Below is her the Visa timeline.
Receipt Date- December 26, 2012, L-1A
Received RFE - February 15, 2013
Denial L-1 A- May 23, 2013
Notice Of Appeal- June, 24,2013 and Waiting....
Following is timeline for me
Receipt Date - January 14, 2013, L-2 Visa
EAC- 13-90-173215
L2 Visa Denial - May, 23, 2013
H-1B Revocation- January 16, 2013
Extension of H-1B Filled - July, 29, 2013
RFE on H-1 B - August 12, 2013 for proof of Maintaining Non Immigrant Status
Is any Option that I can stay legal on her Dependent in US? Or Change of Status?
