hi gurus,

A person is working for company A on h1. Company A
has also filed for his green card Company A is taken over
by B and becomes B. My questions are

1. Will the h1 for company A be still valid for the person or
a new h1 has to be filed?
2. What happens to the green card processing? Will new labor certification be reqd for the new company or it can be transferred ?
 
Not an issue at all

1. YES the H1 from company A will be still vaid.
At the time of renewal at the end of the first 3 years, he has to file the H1 in company B\'s name.

2. No, the same LC can be used. In mergers between companies company A takes over all assets and liabilities of company B. So anything filed under company A\'s name is still valid in Company B\'s name.

Make sure you keep all press releases from Company A and B about the their mergers.
