Green card taken away by CBP, statutory declaration signed.

Hello,

I had my Green Card taken away in Sep 2016 by the CBP prior to boarding a flight to the US. I am living in Canada now and had not satisfied my requirements to maintain US residency. It was only a matter of time unfortunately.

My options were to sign a Statutory Declaration to relinquish it on the spot, or go to an Immigration hearing with the requirement that i stay in the US until that hearing (obviously not possible, since I live in Canada). So I signed a Statutory Declaration and relinquished it. After 30 years, green card gone!

My understanding is that i now have to file form 8854. Is this correct?

Also, knowing that I signed a Statutory Declaration, do i also need to fill out form I-407?

Hi Jo,

I'm not sure if you need to fill out form 8854 but here is a link with additional info on this https://www.irs.gov/instructions/i8854/ar01.html and here info on the form I-407 https://www.uscis.gov/sites/default/files/files/form/i-407instr.pdf I don't think you need to fill out the form I-407
