GC-holder to sponsor unmarried son over 21

Hi,

My mother is a green-card holder, and my younger brother, who is aged 25 years and never married, is in the USA on F1 visa. If my mother applies for green card immigration petition for my brother, I understand that it is currently taking around 9 years for such cases to be completed. The question is, if my mother applies today, and given that my brother is already in the USA, can my brother then continue to stay and work in the USA (on the grounds that his green-card application is pending) until the final green-card is approved maybe 9 years from now? If so, he would like to apply. Or, on the other hand, does my brother have to leave the USA after F1 expires, and come back to the USA only after his green card is approved maybe 9 years from now?

sorry but your brother would have to leave and wait for it to come current. Also if your mother was a USC it might move faster. Unless while he is here is marries a USC and then do the paper work.
