Hello All,
My present employer promissed me an pre-approved labor(PAL) certification if I join with him. He filed my 140&485 with that PAL. But after 2 years INS rejected 140 & 485 saying some body applied for GC with the same labor. In reality, guy who applied before for GC with this labor opted consular process in INDIA. Later he got GC with different employer and this labor not been used once. US Consular in India sent a mail to employer saying this original labor sent back to petitioner. Neither attorney nor employer not received back. Mean while I got my EAD and working with that. Itz been 10years inthis country. Now I'm out of status & my employer is not responding to my calls & mails. What should I do? I do have all communicating mails. Plz let me know. Any help is greatly appreciated.
