Hi

My company's lawyer says filing EB2 under perm has a lot of scrutiny
"We caution the employer not to file a labor certification case in the EB-2 preference category unless the permanent job opportunity legitimately requires a minimum of a master’s degree or the equivalent of the same"

I am a software engineer (java/j2ee using websphere)
Have 5+ yrs of experience
my 4 yrs degree was in chemical engineering, from india

Want to file Perm EB2

What are the requirements for it?
How tough it is for the attorney to prove that this position really requires special skills and hence EB2 !?
What care should be taken for filing?
What should be mentioned in the advertisements?

All techies who have got LC with EB2, please share your experience

What is job offered to you and its requirements? Do your company willing to pay prevailing wage for that position offered to you?

If the job offer requires BS (4yrs) with 5 yrs exp, you may qualify.
How tough it is for the attorney to prove that this position really requires special skills and hence EB2 !?

What should be mentioned in the advertisements?

my employers office is in novi, MI
currently i get 65k
he might be able to ADJUST if required

regarding job offer-
i am already working for him
he would not mind to give whatever ad necessary to file EB2 PERM

its not the employer, but the lawyer who is not confident

before joining this company, how many years of exp do you have?

if i am not mistaken
job ad, and job description will be prepared by attorney

and he will state that 5+ yrs are required

please throw more light on why i "may or may not" qualify even after that

EB2 + Software Architect?

I have a friend who is an Senior Software Architect. His skill set does need Master Degree (he has Computer Science MS) plus many years experience. He said that his lawyer filed his PERM LC with EB2. His salary is very high (100K). His lawyer said he used the upper level PWD to qualify EB2. His PERM is still pending.

I am wondering if he will get an audit or even denied because of the software+EB2 formula. Can someone clarify if it's possible to file PERM by EB2 under an Architect or Senior Level software job title? I might face the same case. Gurus, please help! :confused:
