I have a PhD in Computer Engineering from a good school in US. I am on J1 visa subject to 2 year residency in Pakistan. Waiver is hard to get as J1 was issued by US Department of state under Fulbright Scholarship. But i have the following question
While being on J1, can I apply for EB-2 National Interest Waiver (also known as I-140) for the time being without applying for permanent residence I-485? The idea of doing this is to get a job and continue to work full time. I am having hard time finding a job due to J1 and home residency requirement. I understand that EB2 NIW won't waive the residency requirement but can it allow me to work for unlimited time or at least couple of years?
To clarify further, i am not applying for 2 year home residency waiver. All i am asking is can i work in US for couple of years with EB2 NIW without going for a permanent residence.
