E-2 Extention denial and over staying

I have...
1. Entered U.S as F-1 student in April 2006.
2. Changed the status to E-2 Feb 28, 2008 (valid untill Feb 28, 2010)
3. Filed for E-2 Extention Feb 26, 2010. (I-129)
4. Recived I-797E for requesting Evidence. (Due by June 8, 2010)
5 Submitted additional document before the due date.
6. Received denial June 21, 2010
7. Submitted the appeal now July 21, 2010.

Is it possible that I am over staying?? if so, as of when?
(My understanding was I am illegal as long as I do legal action)
If USCIS denai my appeal then, I would be over staying? as of when??
 
The reason was the evidence was not sufficiently clear for the position, Supervisory or Essential skill position. It says "There is no appeal to this desision. However, pursuant to 8CFR 103.5 , a motion must be accompanyied by the proper fee and file within 30 says of this notice. Not exactly mentioned when should leave. I got recieved I-797C for appeal!? My question is that when is the over staying begins, as of original I-94? or the denial day? I need to count the 180days. Please help me out.:eek:
