Domestic ABUSE after marriage on K1 visa

I came to this country about 7,5 months ago on K1 visa. Got married 6 months ago...
Now that my husband showed his true colors i dont find it possible to stay with him any more, because i dont feel safe. He was screaming at me, pushing me around, grabbed me and threw over the bed, so that i fell on the floor...I left the house immediately before something worse would happen.
I didnt call police because i wasnt sure how that'll affect me. I wanna stay in this country but dont wanna live with my husband. I dont know what rights i have in this situation and what the ways out of the situation are.
I already have my work permit and SSN but the rest of paperwork is still in process.

I need some professional advice. Please help!

It seems we have the same issues.
I got married on a k-1 visa October 2007 and got my conditional green card in april 2008. I have been consistently abused by my wife. I found out that she had some psychiatric issues when I got married, she has bulimia and borderline personality disorder and threatens suicide frequently. She recently cheated on me with another guy. She just told me I can go ahead to file a divorce if i want. I am very confused, I don’t know what to do. Please I need your advise. Please help me.

You are NOT required to stay with your spouse in order to remove your conditions if there is domestic abuse, or a bona fide breakdown in marriage.

To answer the main question about what your rights are regarding your status and greencard, I have copied and pasted my reply to someone who was in a similar situation a few months back.


Wow. Im so sorry to hear what youre going through. Not only is this difficult for any woman to go through, but having to go through it away from your family is extremely tough.

Now Im not well versed on how to deal with immigration due to these issues, but rest assured, you are not alone. Here are some links to help you and to offer you assistence. The particular area of law that you are looking at is VAWA (violence against women act) which protects immigrants and allows them to gain legal status following domestic abuse/battery- they allow you to 'self petition'....so in your case, once your 2 year conditional greencard is approved, if you go through the correct motions, you should be able to self petition to remove the conditions once your greencard is due to expire.

I would definitely advise speaking with an experienced immigration lawyer.....dont just get any old lawyer....make sure they specialise in immigration.

:mad:ya sorry to hear that ur in such situation as i heard the same thing regarding VAWA visa there is some info on this site www.womenslaw.org fine *immigration*< here u be able to view and gain alot of information when it comes to abuse, u can also gain permanent residency through VAWA if u r going throu situations like u described.
