I have less than a year in my 6 year limit and planning to look for a pre-approved. I have been reading about retro. of PD and am not sure how it will affect me. I have a couple of questions:
1) Assume, I get a approved labor sometime between Dec 2004 or feb 2005, can I go ahead and file for my I140? or should I wait for VISA numbers to become available.
2) Assume, my 6 year limit expires in Jun 2005, can I file for my 7th year extn. based on the pre-approved labor?
Are there any other issues, in taking a pre-approved at this stage? Please let me know if I am missing something. I understand, I would not be able to apply AC21 if necessary. Are there any other draw back of retro. apart from applying for I485?
Please clarify. I have to move forward depending on your answers. Also, if anyone is working for a co. with pre-approved, please let me know.
