Can I appy for J1 waiver when I am outside US?

Hi, guys, I had been in US from 2006 to 2009 holding a J1 visa as EV. Now I want to return US. According to the new 24 months bar, I can not return US with J1 visa. Other option may be H1 visa. But the I need to get J1 waiver before applying for H1. My question is: can I apply J1 waiver without a valid J1 visa (sine I am outside US) ? Thank you in advance for your helpful message.
