Can GC holders adopt an Indian baby if the baby is in USA

    We are waiting for our GC, it may come any time.
    We want to adopt our friend\'s new born baby.
    They also live in the US, but on H1 visa.
    Is there any chance of doing that?.
    Any info is really appreciated.

    Yes you can adopt your friends\' child after you have ur GC.
    We are also looking for an Indian child who is here in the US, any info would be appreciated (we already have our GC)

    No , you can\'t. You can only if you satisfy these criterias (absurd rules)
    The INS rule is go and stay with the baby for 2 yrs in your country where you adopt the child then only it will be called a "child"( how will u maintain GC) . Apply for the child\'s GC in family category ( so it will take another 4-5 yrs)

    If you are and the child\'s parents are legally residing in the United States, you may adopt their child. the adoption must be accomplished in court according to the laws of the state you are residing in. However, the child\'s parents will lose all legal rights, etc. upon the finalization of the court action. In addition, the child will NOT be eligible for a green card until the child has resided in the physical care of and in the legal custody of the adopting parents for two years. The child will never be able to petition for the biological parents.
