Can a U.S. Citizen sponsor his mother who overstayed her tourist visa in the U.S.?

I have a friend who is married to the U.S. citizen and is about to become a citizen himself. His mother overstayed her tourist visa awhile back. Can son sponsor his mother while she is here or does she need to go back to her country before he can file for her?

Yes and no. INS could deny adjustment on a visa fraud charge. They are so famous for things like that.
