B-2 visa for newborn?

My wife and I are GC holders and recently had a baby in India through surrogacy. It is not clear if the situation described in 9 FAM 42.1 applies in our case since we went through surrogacy and we were still in the US when the baby was born.
My question is, if we are not able to get the visa waiver, can we apply for a B-2 visa for our baby? Has anyone been in this situation?

The US Govt. provide this facilities to citizens of some specific countries for travelling, business meeting, tourism or while in transit for up to 90 days, in the same manner Republic of India also does provides VWP for specific countries including US, Cyprus, Cambodia, Jamaica, Hong Kong. thus, I think you need not to apply for B-2 visa
