Difficult AC-21 case- advice needed

My case details are as follows:

EB2 case with labor substitution:
RD/ND - Dec 26 2002 at TSC - I-140 approved Oct 2003.

I left the job and moved to Chicago in July 2003 (after 180 days) in a similar job - my case got transferred to Chicago local office Oct 5 2004 - I got refingerprinted in June this year - yesterday I got an interview notice for Dec 6 2005 at the Chicago local office.

Unfortunately, the situation at work has taken a turn for the worse and I'm not sure if I 'll have this job by that date - questions -

1. If I find a job in a different city does that raise a red flag even if other details are OK?

2. Do I need to be actively employed in a firm on the day of the interview or do I need to merely need to produce an offer of employment (in which case I'm not sure how I can produce the pay stubs they are asking for)?

3. Is it possible to get these interviews postponed (in the event I can't find a job by then)?

4. Is an affidavit from parents acceptable in the place of a birth certificate?

5. My medical test results were filed with the original application but I'm being asked to produce original ones - any ideas?

6. My wife's case was filed separately in the Nebraska center after we got married, in June 2004 - does the status of my case influence her filing, i.e. automatic denial in the case of my denial.

Any help will be greatly appreciated.

I am currently qualified for filing AC-21, Can I file for AC21 WITHOUT providing any information regarding I-140 ?

(Currently My I-140 got approved, but did not have
I-140 receipt or I-140 approved document or any related information)

Yes you can. Atleast you should have the receipt number for 140, get an online approved status printout, that should be enough. If you don't even have receipt number, try to get it by calling USCIS asking for some 485 related question, and see if you can get an associated 140 receipt number.

It seems that a good portion of cases involving AC21 have received REFs. Is this a fair observation? Thanks.
 
Got the e-mail from USCIS-CSSO@dhs.gov last night, my I-485 has been approved!!! God damn, I thought this day would never come...

Here is detailed info:

02/15/2002 - Priority date
10/25/2004 - Concurrent filing of I-140 and I-485 (EB2 China)
05/13/2005 - I-140 approved
08/29/2005 - Changed employer, filed AOS portability letter
07/25/2006 - I-485 approved

No RFEs.

For those who are still waiting, there is a light at the end of the tunnel, just sit tight and you'll get there eventually. Good luck!

Congrats man! Could you tell some more about your AC21. Did u had a copy of LC/140 with job duties? what all u did for AC21 filing?

THe-Dude can you please tell us, if your old employer create any issues like withdraw 140 etc for you ?

My old job title was network engineer, and the new one is program manager. Both employers use the same law firm, and the lawyer notified USCIS with an AOS portability letter indicating I changed job. I didn't change anything in the job description.
 
AC 21 Portability

I have filed my GC with a consulting firm and I am working for a diffrent company. I am currently waiting for my I-485 approval. So, my questions are:

1) Should I work for the consulting firm. If yes, can I work for them for 6 months and with AC 21 portability, can I switch to a different company.

2) Should I just apply for AC 21 portability and just work for my current company.

I would appreciate any thoughts or inputs on the complications in switching the employers.
 
AC 21 related questions..

I am working for comp A, state A and have pending labor from comp A. I am on 8th year H1 extension.
I have approved labor, 140 and pending 485 from comp B, state B. I have applied for future employment from this very small company.
Comp B is a very small company and not sure how they will support when needed.

Now i got a query asking why am in a different location from comp B where I intended to work as it is a future employment.

What would be a better option:

1. Continue working for Comp A and keep applying for H1 extension every year and get a letter from comp B that I will work after 485 approval.

2. Apply for AC21 and continue working for the current employer A. If I do AC21, will i loose my H1 status.

What are the pros and cons to the above options.

Suggestions are highly appreciated.

AC21 question

Hi all,

I got my I140 approval on Oct. 13. My I485 has been pending for more 180 days. I'm moving to work for a different employer (similar job) on Oct. 30.

Do I need to file an AC21 application?
When should I file it? before or after my move ?

on 11/26 we got 12 emails of our 485 approvals. I am thankful to UnitedNations and Mr Rajiv Khanna , both helped me to get this done.
My history.....
Company filed my Labor approved in 2 years ,Comapny filed my I-140 and finally got approved in 20 days. Then they did not want to file 485 , as they wanted me to keep as a slave. I was really a slave. Had no option. Might be you guys know all those things......I used to work for BIG 5 and got laid off in 2001. so I came know know about these desi shops. I became am employee for a desi shop in 2001. They flied my lab in 2001, got approved in 2003 exactly in 2 years. Then after my so many requests they filed my I-140 and got approved in 20 days.

After than my tough days started......they were just making an excuse not to file i-485, I filed by myself without having approval copy of 140. I just printed ot my status of 140 from site and sent out documents for 485. It took exactly 2 years to get my 485 approved.
I filed AC21 sent out all required documents. exactly after 6 months of filing 485.

A simple yet trick issue, pls help!

I know that, by rule of thumb, a person needs to stay with his/her current employer for at least 6 months after getting Green Card.

In my case, Company A sponsored my H1b, Labor Cert and I140. I left Company A using AC21 (I140 approved and I485 pending for more than 6 months) to join Company B. Company B sponsored H1b transfer, but it has nothing to do with my Labor Cert, I140 and I485.

My question is, if I get Green Card approved while working at Company B, do I still have to stick around for 6 months, or I can left right away since Company B is NOT my Green Card Sponsoring Company?

Aaron13 - What may happen if I were to leave my GC sponsoring employer within 6 months after approval ?
Is there anything the employer can do to hurt me or is there any reason why INS would ask for employement verification,etc after approval.
