Gap in I-94. Please advice

Dear all:

Here is my situation. I had applied for an H1B extension, and I got the approval after several months. However there is a gap in the I-94 dates in the approval notice. Please see below.

Old H1-B expired on 4/20/2002
Extension application mailed to BCIS on 4/19/2002
New H1-B approval received on 9/23/2002 with validity dates 9/15/2002 - 10/15/2004.


There is a gap from 4/20/2002 to 9/15/2002 on my I-94, although I had mailed the application before the old I-94 expired.

Is this a problem? Will this come up during my permenant residency I-485 stage? I assume this is an error on the BCIS side.

Please share your advice.

Yes this will be a problem Check the i129 whether you entered correct dates. whatabout the receipt date? You have to appeal and correct the dates, even for the current H1 this is not good. And yes, it is not good news for I485...
