I-539 or I-824
Hi all,
I need your opinion or suggestion in my situation if you can. I am on H1-B visa in US. I can stay until Oct'13,2003. My wife who is a PR has applied I-130 for me in May,2000 and it is approved. Now I am waiting to apply for a V visa in May,2003 (form I-539) which is currently taking 6 months for approval. But if it doesn't get approved before Oct'13,2003 I have no choice but to leave the country. Meanwhile I was thinking of filing for consular processing(I-824) but it is taking more than a year for approval(VSC currently process 02/27/2002). Do anybody know if I can stay back in US since my I-130 is approved and my petetion for V Visa (I-539) is pending? |
